OVER a period of weeks, a Sydney dentist allegedly went to nursing homes and filed down the teeth of a dozen elderly residents without their consent, a court has heard.
Dr Andrew Istephan, 34, has pleaded not guilty to 12 counts of assault occasioning actual harm on nursing home residents between September and November 2011.
At the opening of his trial crown prosecutor Gary Corr told the Downing Centre District Court that Istephan had been contracted by the organisation, Elderlink.
The organisation, which provides health services to nursing homes, outsources procedures and then takes fees from the money provided under government schemes.
The rest of the funding is provided to the specialist providing the care.
Of the dozen people Istephan performed procedures on, Mr Corr said only three - Ethel Walker, Nancy Johnston and Ealinor Huxley - were capable of giving consent themselves.
"On all of these persons he filed their tooth or teeth down for the preparation of a crown," Mr Corr said.
"Those three women will say they did not consent to having their teeth filed down."
The other nine people were not capable of consenting due to dementia or other issues.
Mr Corr says the families of these people were not consulted about the dental work.
"You will hear that the majority of those cases the preparation for crowns occurred on the first time.
"Within minutes of examining them he had drilled around at the enamel of the teeth in order to prepare for crowns."
Defence barrister Gregory Heathcote said when a patient was not capable of giving consent, Istephan gained permission from staff at the facilities, which included homes run by Uniting Care.
He said Istephan then proceeded "out in the open", drilling and making moulds of patients' teeth.
The trial before Judge David Frearson continues.
